As a direct access immigration barrister it is rare that you end up in the Supreme Court. However the case of Johnson, see blogs passim, describe the history of this case. It basically boils down as to whether the SSHD is entitled to discriminate against someone if they are illegitimate. In this case the client has committed manslaughter so the Secretary of State and Home Office have chosen to fight.

The FTT Judge, who happens to be the head of Goldsmith Chambers, Mr Tony Metzer QC allowed his appeal under article 14 – having dismissed it under article 8. The SSHD certified the claim as clearly unfounded and set removal directions.

I sought an injunction and obtained one. I also sought permission to apply for JR which was granted on the papers by Mostyn J. The matter then came before Dingemans J who allowed the application. the SSHD appealed and won.

We sought, and by we I mean the excellent Barnes Harild and Dyer and the equally excellent Paul Turner (no relation) and the superlative Hugh Southey QC for an injunction and for permission.

Permission was granted as was a stay and the matter is now listed for a hearing on 25 July 2016. This will be televised and will be a really interesting and law making case.

Obviously this is a case at one end of the spectrum and outside our normal remit. As soon as there is any news I will update my readers.

On a more prosaic note I have been approached by Italians who have asked what is their status following the Brexit vote. My short response to them is breathe and do nothing as its too early to know how this will effect EU nationals.
