This is another case which merits reporting as a direct access immigration barrister. My client had been through the immigration mill, he had been through a number of solicitors, some who spoke his language and some who did not. He had paid in excess of £15,000 or so, from what I could gather in being given the run around.
The trick, if you like in the heading is that he got his travel document and was able to travel.
My client came to the United Kingdom in 1998, an Iranian national whose life had been toyed with and ruined only because of the job he found himself doing that made him privy to confidential government information. He entered into a relationship with an EEA national in the United Kingdom but had no passport. Prior to the amendments to the Immigration (European Economic Area) Regulations 2006, the fact that he fled from Iran without a passport was enough for the Secretary of State to stop him being able to legally enjoy his relationship with his EEA partner. When my client came to me, the long-running battle with the Secretary of State which he had, up until recently been losing had forced him to attempt to take his own life.
Following an application for judicial review in the Upper Tribunal which was settled by the Secretary of State proposing a consent order in which she agreed to reconsider his claim, I am delighted to report that my client has been granted a residence card.
